A US federal appeals court has directed President Donald Trump's administration to arrange the return of a man who was wrongly deported to El Salvador in breach of a court order.

A three-judge panel from the 2nd Circuit Court of Appeals ruled Tuesday that Jordin Alexander Melgar-Salmeron's deportation was "improper" as it went against the administration's own assurances to the court that he would not be removed, ABC News reported.

The decision to arrange the return of the 31-year-old Salvadoran – who was deported last month just minutes after a federal appeals court blocked his removal – is the fourth documented case of a migrant being ordered back to the US after being wrongly deported.

Two of the migrants – Kilmar Abrego Garcia and a Guatemalan man referred to in court documents as O.C.G., who was mistakenly deported to Mexico – have already been returned to the US. Abrego Garcia, who the administration refused to bring back after his case made headlines, was only returned to the US early this month when the US decided to file charges against him.

The federal court instructed the administration to ease Melgar-Salmeron's return "as soon as possible" to ensure his case proceeds as it would have if he had not been wrongfully deported to El Salvador.

The Trump administration was additionally ordered to submit a declaration from someone with direct knowledge of the 31-year-old’s current whereabouts, outlining the steps the government will take to bring Melgar-Salmeron back to the US.

Since taking office, a Trump administration crackdown on irregular migrants has drawn a backlash. Many accused Trump of seeking to deport law-abiding members of the community, many of them longtime US residents, rather than the criminals he had vowed to get out of the country.

Moreover, migrants claimed to be criminals were not given due process to challenge any accusations against them before their deportation.
