Supreme Court allows Trump to strip deportation protections from Venezuelans

WASHINGTON 

The Supreme Court allowed the Trump administration on Monday to lift deportation protections for hundreds of thousands of Venezuelans living in the US.

What is known as Temporary Protected Status (TPS) was first granted to Venezuelans on humanitarian grounds in 2021, and was extended in 2023 due to political upheaval and a stark economic downturn in the South American nation. It was last extended on Jan. 17 during the final days of the Biden administration ahead of its expiration in April.

Department of Homeland Security (DHS) Secretary Kristi Noem in February rescinded the 2023 extension, prompting a legal battle that culminated with the Trump administration seeking the Supreme Court's intervention on an emergency basis after a district court ruling that TPS should be reinstated for Venezuelans.

The Supreme Court's decision's to grant the Trump administration's request clears the way for officials to move forward with deportations. The brief unsigned order notes that only Justice Ketanji Brown Jackson, an appointee of President Joe Biden, was in dissent.

Prior to the ruling, the DHS said on its website that it "has every intention of ending Venezuela TPS under the 2023 designation as soon as it obtains relief from the court order."

TPS allows migrants to live and work in the US legally if there are "conditions in the country that temporarily prevent the country's nationals from returning safely, or in certain circumstances, where the country is unable to handle the return of its nationals adequately."

Qualifying conditions in the home country include armed conflict, epidemics, environmental disasters or "other extraordinary and temporary conditions."
